Lindsay Ell wrote this guitar-driven country-rock song with Fred Wilhelm and Chris Stevens for her The Project album. Released as the follow-up to "Waiting on You", it reached #1 on the Canada Country airplay chart. It was not only Ell's debut chart-topper, but also the first single by a solo female artist to reach the peak position on that tally since Terri Clark's "In My Next Life" in 2008.
The lyrics refer to the adrenaline rush of a new love. Eli explained to iHeart Radio: "It talks about, 'I feel like I'm falling in love with you so much that you're stealing my own heart away from me.'"
"Criminal" along with the rest of the album was produced by Sugarland's Kristian Bush. Ell described him as "like Yoda in the studio" and a "mad scientist."
